Italian public procurement is governed by the Codice dei Contratti Pubblici (Legislative Decree 36/2023), a comprehensive reform that replaced the previous 2016 code. The new framework emphasizes digital-by-default procurement, result-oriented principles, and self-declarations (replacing extensive upfront documentation). ANAC, the national anticorruption authority, serves as the oversight body, maintaining the national database of public contracts and enforcing compliance. All above-threshold tenders are published on TED via eForms.
Italy uses standard EU procedure types but with specific national adaptations. Open procedures are the default for above-threshold contracts. Below threshold, contracting authorities may use “affidamento diretto” (direct award) for smaller amounts or simplified negotiated procedures. Consip, the national central purchasing body, manages framework agreements that all public administrations can access, particularly for IT, telecommunications, and office supplies. Regional purchasing centrals (like SCR Piemonte, Intercent-ER, and Aria Lombardia) operate their own frameworks for regional needs, using CPV codes throughout for classification.
